1. Acceptance of Terms

By accessing and using the services of NMG Outdoor Living ("Company", "we", "us", or "our"), you ("Customer", "you", or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and customers of our website nmgpvcsupplies.co.uk and our services.

2. Services Provided

NMG Outdoor Living provides:

• Design, supply, and installation of garden saunas
• Construction of grill pods and outdoor kitchens
• Custom garden sheds and storage buildings
• Garden rooms and home offices
• Stables and equestrian buildings
• Related consultation and project management services

3. Quotes and Estimates

• All quotes are valid for 30 days from the date of issue unless otherwise stated
• Quotes are based on the information provided by the customer and site inspection
• Final costs may vary if site conditions differ from initial assessment
• Quotes do not include costs for planning permission or building regulations approval
• Additional work requested during the project will be quoted separately

4. Payment Terms

Standard Payment Schedule

• 30% deposit upon acceptance of quote
• 30% upon commencement of work
• 40% upon completion of project

Payment Methods

• Bank transfer (preferred)
• Credit/Debit card
• Cash (for amounts under £500)
• Cheque (must clear before work commences)

Late payments may incur interest charges of 8% above the Bank of England base rate per annum.

5. Project Timeline

• Project timelines are estimates and subject to weather conditions and material availability
• We will notify you of any significant delays as soon as possible
• The Company is not liable for delays caused by circumstances beyond our reasonable control
• Customer-requested changes may affect the project timeline

6. Customer Obligations

The Customer agrees to:

• Provide accurate information about the site and project requirements
• Ensure site access for our team and equipment
• Obtain necessary planning permissions or building regulations approval
• Clear the work area of obstacles and valuables
• Provide access to utilities if required (water, electricity)
• Secure any pets during work hours
• Notify us of any site hazards or restrictions

7. Warranties and Guarantees

Workmanship Warranty

We guarantee our workmanship for a period of 5 years from the completion date. This covers defects in installation and construction.

Materials Warranty

Material warranties are provided by the manufacturer and vary by product. We will provide warranty documentation for all materials used.

Warranty Exclusions

• Damage caused by misuse, negligence, or lack of maintenance
• Normal wear and tear
• Damage from extreme weather events
• Modifications or repairs made by third parties
• Damage caused by failure to follow care instructions

8. Cancellation Policy

Customer Cancellation

• You have 14 days from signing the contract to cancel for a full refund
• Cancellations after 14 days but before work commences: 30% deposit retained
• Cancellations after work has commenced: full payment for work completed plus 50% of remaining balance

Company Cancellation

We reserve the right to cancel a project if site conditions make it unsafe or impractical to proceed. In such cases, any deposits paid will be refunded in full.

9. Changes and Variations

• Any changes to the agreed specification must be requested in writing
• Changes may affect the project cost and timeline
• We will provide a written quote for any additional work
• Work on variations will not commence without written approval

10. Insurance and Liability

NMG Outdoor Living maintains comprehensive public liability insurance and employer's liability insurance.

Our Liability

• We are liable for death or personal injury caused by our negligence
• We are liable for damage to property caused by our negligence
• Our total liability is limited to the value of the contract

Liability Exclusions

• Indirect or consequential losses
• Loss of profits or business opportunities
• Damage caused by third parties
• Pre-existing site conditions not disclosed

11. Intellectual Property

All designs, plans, and project documentation remain the intellectual property of NMG Outdoor Living. Customers may not reproduce or share our designs without written permission.

12. Photography and Marketing

We may request permission to photograph completed projects for marketing purposes. You have the right to decline or request anonymity. We will not use photos without your consent.

13. Complaints Procedure

If you have a complaint:

1. Contact us immediately by phone or email
2. We will acknowledge your complaint within 2 working days
3. We will investigate and provide a response within 14 days
4. If unsatisfied, you may escalate to an industry ombudsman or seek legal advice

14. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to: extreme weather, natural disasters, strikes, material shortages, pandemics, or government restrictions.

15. Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR.

16. Governing Law

These Terms of Service are governed by the laws of Northern Ireland and the United Kingdom. Any disputes will be subject to the exclusive jurisdiction of the courts of Northern Ireland.

17. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
